Limited warranty

This Limited Warranty covers defects in
materials and workmanship under normal and intended use during the applicable Warranty Period.

A Product may be considered defective if it has:

• Visible physical damage upon
  receipt or first opening of the sealed package;
• Missing or incomplete contents;
• A defect in materials or
  workmanship that renders the Product unusable or materially impairs its intended functionality, including, for example, a broken collar clasp, leaking container, damaged packaging, or non-functioning electronic device.

This Limited Warranty applies only to the original purchaser and is non-transferable.

This Limited Warranty does not cover problems resulting from:

• Conditions, malfunctions, or damage not caused by defects in materials or workmanship;
• Improper installation, application, storage, handling, maintenance, or use contrary to provided instructions;
• Accidents, misuse, abuse, neglect, modification, alteration, or unauthorized repair;
• Damage caused by environmental exposure, including excessive heat, moisture, water damage, chemical exposure, or other external conditions;
• Normal wear and tear, cosmetic damage, or deterioration from ordinary use;
• Battery depletion or reduction in battery life resulting from normal use;
• Replacement of consumable components;
• Individual sensitivities or allergic reactions in pets or humans; or
• Any circumstance otherwise excluded under this Limited Warranty.

Factors Affecting Product Performance

TicklessUSA products are designed to assist in helping to keep ticks, fleas, mosquitoes, dust mites away and to reduce the chance of their bites. However, product performance may vary depending on factors beyond our control, including environmental conditions, weather, pest population levels, animal behavior, geographic location, application methods, compliance with product instructions, and other external circumstances.
Accordingly, while we stand behind the quality and manufacturing integrity of our Products, this Limited Warranty does not guarantee that any Product will:

• Prevent all pest encounters;
• Achieve a particular level of pest repellency in all circumstances;
• Remain effective for a specific period under all conditions; or
• Ensure that a user, pet, or animal remains free from ticks, fleas, mosquitoes, dust mites.

Customer dissatisfaction with the actual or perceived effectiveness of a Product, standing alone and absent a defect in materials or workmanship, does not constitute a warrantable defect and is not covered by this Limited Warranty.

The applicable Warranty Period begins on the original date of retail purchase and varies by Product category.

Citronella-Based Products

Citronella-based collars, spot-on products, sprays, and similar products are covered by this Limited Warranty for thirty (30) days from the original date of purchase.

Ultrasonic Products – Button Cell
Battery Models

Ultrasonic products powered by button cell batteries are covered by this Limited Warranty for six (6) months from the original date of purchase.

Ultrasonic Products – Rechargeable
Battery Models

Ultrasonic products powered by rechargeable lithium-ion batteries are covered by this Limited Warranty for twelve (12) months from the original date of purchase.

Any replacement Product provided under this Limited Warranty shall be covered for the remainder of the original Warranty Period or thirty (30) days after replacement, whichever is longer.

You may be required to provide:

• Proof of purchase;
• A description of the alleged defect;
• Photographs or videos of the Product; and
• Any additional information reasonably requested to evaluate the claim.

We reserve the right to require return of the Product for inspection and evaluation and will provide return instructions if necessary.

If we determine that a Product contains a defect covered by this Limited Warranty, we will, at our option:

• Repair the Product;
• Replace the Product with the same or a substantially similar Product; or
• Refund the original purchase price paid for the Product.

These remedies are the sole and exclusive remedies available under this Limited Warranty.

EXCEPT AS EXPRESSLY PROVIDED IN THIS LIMITED WARRANTY, WE MAKE NO OTHER WARRANTIES, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

TO THE EXTENT AN IMPLIED WARRANTY CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, SUCH IMPLIED WARRANTY SHALL BE LIMITED TO THE APPLICABLE WARRANTY PERIOD SET FORTH ABOVE.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO ANY PRODUCT OR THIS LIMITED WARRANTY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT THAT IS THE SUBJECT OF THE CLAIM.
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITIES, LOSS OF DATA, PROPERTY DAMAGE, VETERINARY EXPENSES, MEDICAL EXPENSES, OR OTHER ECONOMIC LOSS.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

This Limited Warranty gives you specific
legal rights, and you may also have other rights that vary from state to state.

Nothing in this Limited Warranty is
intended to limit any rights that cannot be lawfully excluded under applicable
law.
